These Terms & Conditions (“Terms”) apply to your use of the Fresh Standard Cleaners website, Google Business Profiles, enquiry forms, telephone services and related lead-generation services (“Platform”).
Fresh Standard Cleaners (“Fresh Standard Cleaners”, “we”, “us” or “our”) operates as a marketing and customer-introduction business. We connect customers seeking cleaning services with independent cleaning contractors who may be able to provide those services.
By submitting an enquiry, requesting a quote, contacting us, or using our Platform, you acknowledge and agree to these Terms.
1. Our Role
Fresh Standard Cleaners primarily operates as a marketing, advertising and customer-introduction service.
Where a customer requests cleaning services through Fresh Standard Cleaners, we may collect the customer's enquiry details and provide those details to an independent cleaning contractor (“Contractor”).
Unless expressly stated otherwise in writing, Fresh Standard Cleaners does not personally perform, supervise, manage or control the cleaning work performed by the Contractor.
Once an enquiry has been introduced to a Contractor, the Contractor may contact the customer directly to discuss the requested work, provide a quotation, arrange a suitable time, determine the scope of work and perform the cleaning services.
The agreement for the actual cleaning services may therefore be between the customer and the Contractor.
2. Independent Contractors
Contractors introduced through Fresh Standard Cleaners operate independently and are responsible for their own business operations, employees, subcontractors, equipment, methods, pricing, scheduling, insurance and performance of cleaning services.
Unless expressly stated otherwise, a Contractor is not an employee, partner, joint venturer or agent of Fresh Standard Cleaners.
Fresh Standard Cleaners does not control the manner in which a Contractor performs cleaning work.
Customers should confirm directly with the Contractor all matters relating to the cleaning service, including:
the scope of work;
price and payment arrangements;
arrival and completion times;
products and equipment;
access requirements;
cancellations and rescheduling;
damage or property concerns;
complaints about the work; and
any warranty, guarantee or rectification arrangements offered by the Contractor.
3. Quotes and Pricing
Any price displayed on our website, Google Business Profile, advertisement or other marketing material may be indicative only unless expressly stated otherwise.
The final price for cleaning services may depend on factors including the size and condition of the property, requested services, accessibility, time required, materials and other circumstances identified by the Contractor.
The Contractor is responsible for confirming the final scope and price with the customer before performing the work.
Fresh Standard Cleaners is not responsible for a Contractor's quotation, pricing decision or changes to a quotation arising from information discovered by the Contractor.
4. Performance of Cleaning Services
The Contractor is responsible for carrying out the cleaning services that the customer engages them to perform.
Fresh Standard Cleaners does not guarantee that a particular Contractor will accept an enquiry, attend at a particular time, complete a particular job, achieve a particular result or remain available after an introduction.
Any complaint concerning the quality, condition, timing, safety or performance of cleaning work should first be directed to the Contractor who performed or agreed to perform the work.
Nothing in these Terms excludes or limits any rights a customer has under applicable Australian law.
5. Consumer Rights
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
Where the Australian Consumer Law applies, statutory consumer guarantees may apply to services supplied to consumers. These rights may include rights relating to due care and skill, fitness for purpose and reasonable time for supply.
If any provision of these Terms conflicts with a mandatory legal right or obligation, that provision will apply only to the extent permitted by law.
6. Customer Enquiries
By submitting an enquiry, you consent to Fresh Standard Cleaners using the information provided to process your enquiry and, where appropriate, passing relevant information to a Contractor for the purpose of responding to your request.
Information may include your name, telephone number, email address, property location, requested cleaning services and other information you voluntarily provide.
You are responsible for ensuring that information supplied to us is accurate and complete.
7. Communication With Contractors
After an introduction has been made, the Contractor may communicate directly with you.
The Contractor may use the contact information provided through Fresh Standard Cleaners to contact you regarding your enquiry and the requested cleaning services.
Any subsequent agreement, quotation or arrangement between you and the Contractor is separate from the lead-generation and introduction service provided by Fresh Standard Cleaners, subject to applicable law.
8. Payments
Unless expressly stated otherwise, Fresh Standard Cleaners does not receive payment for the Contractor's cleaning work on the Contractor's behalf.
Payment arrangements for cleaning services are determined between the customer and the Contractor.
Fresh Standard Cleaners may receive a referral, marketing or lead-generation fee, commission or other commercial remuneration from a Contractor in connection with customer enquiries or completed work.
Where applicable, the Contractor remains responsible for accurately reporting completed work and amounts received under its separate commercial arrangement with Fresh Standard Cleaners.
9. Contractor Commissions and Lead Fees
Fresh Standard Cleaners may have separate commercial agreements with Contractors under which Fresh Standard Cleaners receives a percentage, commission, referral fee or other agreed amount in connection with leads introduced through our marketing channels.
These commercial arrangements do not alter the customer's obligation to pay the Contractor for services the customer has agreed to purchase.
A Contractor must not represent that Fresh Standard Cleaners is responsible for performing the Contractor's work unless Fresh Standard Cleaners has expressly agreed to this in writing.
10. Property Access and Customer Responsibilities
Customers are responsible for providing the Contractor with accurate information about the property and requested services.
Customers must disclose relevant information that may reasonably affect the safety or performance of the cleaning work, including known hazards, restricted areas, fragile items, pets, access difficulties and other relevant conditions.
Customers are responsible for providing lawful and reasonably safe access to the property where access is required.
11. Damage, Loss and Complaints
If you believe that property has been damaged or that there is another problem with cleaning services, you should promptly notify the Contractor responsible for the work and provide reasonable supporting information.
Fresh Standard Cleaners may, at its discretion, assist with communication between the customer and Contractor but does not thereby assume responsibility for the Contractor's work.
Nothing in this clause limits any rights or remedies that cannot legally be excluded.
12. Website and Marketing Information
We attempt to keep information on our website and marketing channels accurate and current.
However, descriptions, photographs, service areas, prices, availability, estimated timeframes and other information may change.
We do not guarantee that all website information will always be complete, current or error-free.
13. Third-Party Contractors and Services
Fresh Standard Cleaners may introduce customers to third-party Contractors.
The use of a third-party Contractor is at the customer's discretion, subject to any agreement entered into between the customer and Contractor.
Where permitted by law, Fresh Standard Cleaners is not responsible for acts or omissions of an independent Contractor occurring after the introduction.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
14. Limitation of Liability
To the maximum extent permitted by law, Fresh Standard Cleaners will not be responsible for loss, damage, delay, inconvenience, expense or other consequences arising solely from the acts or omissions of an independent Contractor after a customer has been introduced to that Contractor.
This does not exclude, restrict or modify liability where doing so would be unlawful.
Where liability can legally be limited, our liability will be limited to the extent permitted by applicable law.
15. No Guarantee of Contractor Availability
Submitting an enquiry does not guarantee that a Contractor will accept the job.
Fresh Standard Cleaners may be unable to provide an introduction where no suitable Contractor is available, the requested service is outside the available service area, the requested work is unsuitable for available Contractors, or for other reasonable operational reasons.
16. Cancellations and Rescheduling
Cancellations, rescheduling and refunds relating to cleaning services are generally matters between the customer and the Contractor who accepted the work.
Customers should confirm the Contractor's cancellation and rescheduling policy before agreeing to the service.
Nothing in these Terms removes any mandatory cancellation or cooling-off rights that may apply under Australian law.
17. Privacy
Personal information submitted through our website or other channels may be collected, used and disclosed for purposes including processing enquiries, connecting customers with Contractors, communicating about requested services, administration, fraud prevention, record keeping and improving our services.
We will handle personal information in accordance with applicable privacy laws and our Privacy Policy.
18. Third-Party Websites and Platforms
Our marketing may appear through third-party platforms including Google and other advertising, search, social media or technology platforms.
Fresh Standard Cleaners does not control third-party platforms and is not responsible for their availability, policies, algorithms, content or technical operation.
19. Prohibited Use
You must not use our website or services:
for unlawful purposes;
to provide knowingly false information;
to impersonate another person;
to interfere with the operation of our website;
to attempt to obtain another person's personal information without authorisation; or
to engage in fraudulent or abusive conduct.
20. Intellectual Property
Unless otherwise stated, website content including text, logos, branding, graphics, photographs, designs and other materials is owned by or licensed to Fresh Standard Cleaners.
You must not reproduce, modify, distribute, publish or commercially exploit our materials without prior written permission, except where permitted by law.
21. Changes to These Terms
We may update these Terms from time to time.
The updated version will be published on our website with a revised “Last updated” date.
Your continued use of the Platform after an update may constitute acceptance of the updated Terms to the extent permitted by law.
22. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable, where possible.
The remaining provisions will continue to operate.
23. Governing Law
These Terms are governed by the laws applicable in Victoria, Australia.
You and Fresh Standard Cleaners submit to the jurisdiction of the courts and tribunals that have jurisdiction under applicable Victorian and Australian law.

Important Australian Consumer Law Notice
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you may be entitled to cancel your service contract with us and receive a refund for the unused portion, or compensation for its reduced value. You may also be entitled to compensation for any other reasonably foreseeable loss or damage.
Nothing in these Terms is intended to remove any rights provided by the Australian Consumer Law or other applicable legislation.
